The tax abatement procedure and rezoning process can be challenging to understand at times. City of South Bend Tax Abatement Process

 1.) Site Selection Process

 1   Assuming 3 visits to area

 2   Discussions with Chamber, Area Plan Commission, etc.

 

 2.) Finalize Choice to Relocate

 3.) Application for Tax Abatement

 1  $250 fee

 2  Filed with City Clerk

4.) Clerk forwards to Dept. Community Investment (DCI) and Common Council for staff review

1  DCI has 15 days to review and prepare report for council

2  Common Council has 15 days to review application

Time can increase if property is in Redevelopment Area
    (Redevelopment Commission)

5.) Redevelopment Commission Reviews

1 39% of South Bend is TIF district

 6.) Common Council Meetings (3)

1  1st and 2nd (Monday): applicant meets with Common Council
     –designation resolution passed

2  2 week wait upon resolution

3  3rd: applicant shows up for confirming resolution

 

 7.) Common Council Approved Resolution

 1 Applicant can pull building permit and start

 

St. Joseph County Tax Abatement Process

 

 1.) Site Selection Process

 1   Assuming 3 visits to area

 2   Discussions with Chamber, Area Plan Commission, etc.

 

 2.) Finalize Choice to Relocate

 3.) Application for Tax Abatement

 1  File by noon the Wednesday before the 1st Tuesday of the month
     (council meeting)

 2  File with County Council Office

 3  Filing fees:  
     • $400 Personal Property
     • $400 Real Property
($250 annual processing fee in subsequent years)

4.) Documents

2  Declaratory Resolution Form

Conformatory Resolution Form

State Form 51764 Personal Property

State Form 51767 Real Estate Improvements

 

5.) 1st Reading

1 1st reading the first Tuesday of the month (council meeting). 
   If approved, assigned to Land Use Planning Committee

 6.) Land Use Planning Committee Reviews

 1  Land Use Planning Committee reviews on the third Tuesday of the month. Applicant attendance required

 

 7.) Declaration Hearing

 1 Declaration Hearing is the 1st Tuesday of the subsequent month. Land Use Planning Committee makes recommendation

 8.) Confirmatory Hearing

 1 If Committee recommends approval, Confirmatory Hearing, with public comment, scheduled for next month’s meeting

9.) Approval

 1  If approved, Commissioner review and approval may be required. This is to be done within 2 weeks of Confirmatory Hearing.
